Your access to our website is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use our website (www.misscaribbean.org).
By accessing or using the Website (www.misscaribbean.org) you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Website (www.misscaribbean.org).
Donations and Purchases of Fundraising Memorabilia
If you wish to donate or purchase any fundraising memorabilia or Website (www.misscaribbean.org) made available through the Website (www.misscaribbean.org) ("Donations and Purchase"), you may be asked to supply certain information relevant to your Fundraising Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Donations or Fundraising Purchase; and that (ii) the information you supply to us is true, correct, and complete.
The Website (www.misscaribbean.org) may employ the use of third party websites for the purpose of facilitating payment and the completion of Fundraising Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.
We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or Website (www.misscaribbean.org) availability, errors in the description, image, or price of the product or Website (www.misscaribbean.org), error in your order or other reasons.
We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
Shipping
All orders will be shipped by carrier of our choice at the time of shipping.
Order Cancellations
Once orders are placed or submitted to us, via our website (www.misscaribbean.org), API, via telephone or any other method, they cannot be cancelled. In the event you wish to cancel an order you have already placed; you may request cancellation by contacting us. We will make every effort to cancel your order, however cancellation is not guaranteed and in most cases, orders cannot be cancelled, even if the order has not already shipped.
Returns, Refunds
Returns will incur no restocking fee. All returns must be authorized. Authorized returns will be issued a Return Authorization (RA) or Return Merchandise Authorization (RMA) number. Failure to request Return Authorization may result in the rejection of your return. Original shipping charges are not refunded. Return shipping charges are the responsibility of the customer. Refunds will be issued as "Merchandise Credit" or "Account Credit" which can be used towards a future fundraising purchase, unless otherwise requested.
Contests, Sweepstakes and Promotions
Any contests, sweepstakes or other promotions (collectively, "Promotions") made available through the Website (www.misscaribbean.org) may be governed by rules that are separate from these Terms & Conditions. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms and Conditions, the Promotion rules will apply.
Limitation of Liability
In no event shall the Miss Caribbean U.S. Beauty Pageant, Inc., nor its directors, agents, fundraising suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if MCUSBP has been advised of the possibility of such damages), resulting from: (a) The use or the inability to use the MCUSBP website; (b) the cost of procurement of substitute goods and services; (c)unauthorized access to alternation of your transmissions or data; (d) statements or conduct of any third party on the MCUSBP website or (e) any other matter relating to the MCUSBP organization

The Website (www.misscaribbean.org) is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of fundraising supplies, fitness for a particular purpose, non-infringement or course of performance.
The Miss Caribbean U.S. Beauty Pageant, Inc. board members and affiliates do not warrant that a) the Website (www.misscaribbean.org) will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Website (www.misscaribbean.org) is free of viruses or other harmful components; or d) the results of using the Website (www.misscaribbean.org) will meet your requirements.
Exclusions
Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
